Nisites Hosting Terms and Conditions of Service 

Glossary of Terms: 

We – meaning Nisites Hosting or the Nisites Group. 

You – meaning you the end user of a hosting account.  

Server – meaning computer equipment which is used to store your website and transmit and receive email messages. 

Bandwidth – meaning data transfer from your hosting account to the outside world. Each of the Nisites Hosting packages has a set amount of bandwidth allocation per month. 

1.  Website Hosting and Electronic Mail 

1a. we make no representation and therefore give no warranty as to the accuracy or quality of information received by any person via the server and we shall have no liability for loss or damage to any data stored on the server. 

1b. you will not use the server in any manner which infringes any UK law or regulation or allow a third party to do so. 

1c. you will not store, upload or transmit to the server any material which is unlawful, threatening, abusive, malicious, defamatory, obscene, pornographic, or otherwise objectionable in any way.

1d. you will not store, upload or transmit to the server any material containing a virus or other hostile computer program. 

1e. we reserve the right to remove any material which we deem inappropriate from your website without prior notice to you. 

1f. you are not permitted to store any data on the server which is not directly accessible via hyperlink from your website (apart from email signature graphics) 

1g. you will not send bulk email from the server of any kind. 

1h. you will not employ programs on the server which consume excessive systems resources. 

1i. you shall keep secure any security creditentials supplied. If at any stage you suspect unauthorized access to your hosting account you must notify us immediately. 

2. Payment 

2a. all payments must be made in UK Sterling or in the case of customers from the Republic of Ireland Euros. 

2b. any payment returned by a bank or credit card company will incur a £100 administration fee, this fee will be added to the total outstanding amount. 

2c. should you fail to pay any hosting fees owed by the due date your account will automatically be suspended. To remove the suspended account status all fees due must be settled along with a £50 reactivation fee. If you account remains suspended for 10 days or more, we reserve the right to terminate the account altogether including any data stored in your account.  

2d. hosting accounts are paid yearly at the initial activation of a hosting account and then on each anniversary year. We will invoice any yearly renewal fees one month prior to the due date.  

3. Termination of Account 

3a. we reserve the right to terminate any hosting account if you should break any of the terms and conditions in this agreement. 

3b. if we suspend a hosting account due to breech by you of this agreement no refund pro rata or otherwise will be issued. 

3c. you are free to cancel your hosting account at any time, if you wish to transfer hosting services to another provider we can provide access to facilitate this for a £35 admin fee, and only if all other hosting fees owed to date have been settled.

3d. if you choose to cancel your hosting account we will not issue a refund of any kind. 

4. Bandwidth 

4a. if you plan to use video or audio files of any description on your hosting account you must inform us before agreeing to a hosting account. 

4b. each hosting account/package that we offer comes with a monthly bandwidth allowance if your account exceeds this monthly allowance on two consecutive months we will charge a fee per megabyte that your limit has been exceeded.

5. Service availability  

5a. we shall use all reasonable endeavours to make available to you at all times the server and the services but we shall not, in any event, be liable for interruptions of service or downtime of the server.
